Simple Civic Access and Generalized Civic Access

SIMPLE CIVIC ACCESS

Anyone has the right to request documents, information or data subject to mandatory publication under current legislation in cases where public administrations have failed to publish them on their website. Civic access, therefore, is limited to acts, documents and information subject to publication obligations.

METHODS FOR EXERCISING SIMPLE CIVIC ACCESS

The request for simple civic access is not subject to any limitation regarding the applicant’s standing, does not need to be justified, is free of charge, and must be submitted to the Head of Corruption Prevention and Transparency (RPCT), Dr. Antonio Capone.
The request may also be submitted electronically, in accordance with the procedures set out in Legislative Decree of 7 March 2005, no. 82, as amended, by sending it to the following email address: segreteria.conisma@pec.it If accepted, the administration will upload the requested data, information or documents to the website and will notify the applicant of the publication, providing the hyperlink to the material requested in the submitted application.

GENERALIZED CIVIC ACCESS

Anyone has the right to access data and documents held by public administrations, beyond those subject to mandatory publication, in compliance with the limits related to the protection of legally relevant interests as provided for by Art. 5-bis of Legislative Decree No. 33/2013. This type of civic access was introduced with the aim of promoting widespread forms of control over the pursuit of institutional functions and the use of public resources, as well as fostering participation in public debate. Generalized civic access may therefore be exercised with respect to data and documents held by public administrations, beyond those for which a specific publication obligation already exists.

METHODS FOR EXERCISING GENERALIZED CIVIC ACCESS

The request for generalized civic access is not subject to any limitation regarding the applicant’s standing, does not need to be justified, and is free of charge. The request may also be submitted electronically, in accordance with the procedures set out in Legislative Decree of 7 March 2005, no. 82, as amended, by sending it to the following email address: segreteria.conisma@pec.it Interested third parties may submit a reasoned objection to the access request within ten days from receiving the notification, using the same methods previously described. If the request is granted, the Entity will attach the requested data and documents to the response. In the event of a total or partial denial of access, or if no response is provided within thirty days from the submission of the request, or in the case of interested third parties when the request is granted despite their reasoned objection, they may submit a request for review to the Head of Corruption Prevention and Transparency, Dr. Antonio Capone, who will decide with a reasoned measure within twenty days.
